OVERVIEW


Welcome to Saints on a Shelf™. Saints on a Shelf LLC, doing business as Saints on a Shelf™ (“Saints on a Shelf,” “we,” “us,” or “our”), operates this store, website, Saintlink™ experience, and related information, content, features, products, tools, and services (collectively, the “Services”).


Saints on a Shelf™ is powered in part by Shopify, which enables us to provide our online store and checkout Services.


These Terms of Service, together with the policies referenced herein (“Terms”), describe your rights and responsibilities when you access or use the Services.


Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

SECTION 1 — ACCESS, AGE, AND ACCOUNTS


By agreeing to these Terms, you represent that you are at least the age of majority in your state or jurisdiction of residence.


The Services, including purchasing products and creating a Saintlink™ or My Saints account, are intended to be managed by adults. A parent or legal guardian may allow a minor dependent to view devotional content using a device and account owned or managed by the parent or guardian.


Children under 13 may not independently create an account, make a purchase, or submit personal information through the Services. Parents and guardians are responsible for supervising their children’s use of the Services.


You may be asked to provide information such as your name, email address, telephone number, billing information, payment information, and shipping address. You represent that the information you provide is accurate, current, and complete and that you have the right to provide it.


You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not sell, assign, license, or transfer your account to another person without our written permission.


Please notify us promptly if you believe your account or Saintlink™ access has been used without authorization.


SECTION 2 — OUR PRODUCTS


We make reasonable efforts to display and describe our products accurately. However, colors and appearance may vary depending on your screen, lighting, device settings, and configuration.


Many Saints on a Shelf™ figurines are individually hand-painted. Minor variations in color, shading, facial details, texture, positioning, or finish are natural characteristics of hand-painted products and do not necessarily constitute defects.


Product dimensions are approximate. Packaging, accessories, product descriptions, and designs may be updated or modified without notice when the change does not materially alter the item purchased.


We reserve the right to discontinue products, revise product descriptions, and limit quantities available to any person, household, geographic region, or jurisdiction.


SECTION 3 — DECORATIVE COLLECTIBLES AND PRODUCT SAFETY


Saints on a Shelf™ figurines are decorative devotional collectibles. Unless expressly stated otherwise, they are not designed or marketed as children’s toys.


Figurines may contain resin, detachable components, small parts, pointed accessories, or other components that could present a choking or injury hazard if broken or mishandled.


Products should be placed on a stable surface and kept away from very young children and pets. Any handling by a minor should occur with appropriate adult supervision.


Purchasers are responsible for reviewing and following warnings and care instructions included with each product.


SECTION 4 — ORDERS


Placing an order constitutes an offer to purchase. We reserve the right to accept, decline, limit, or cancel an order for lawful reasons, including suspected fraud, inaccurate product or pricing information, inventory shortages, shipping restrictions, or unauthorized resale.


An order is not accepted until we confirm acceptance and successfully process payment.


Please review your order carefully before submitting it. We may be unable to change or cancel an order after it enters processing or fulfillment.


If we decline, modify, or cancel an order, we will attempt to contact you using the email address, billing address, shipping address, or telephone number provided with the order.


Purchases are intended for personal, household, gift, or devotional use unless the purchaser has been approved as an authorized wholesale customer. Approved wholesale purchases may be governed by separate wholesale terms.

SECTION 5 — PRICES, PAYMENT, AND BILLING


Prices, discounts, product availability, and promotions may change without notice. The price charged will be the price displayed when the order is submitted, subject to correction of obvious errors.


Unless expressly stated otherwise, listed prices do not include applicable taxes, shipping charges, handling charges, customs duties, or import fees.


Prices offered online may differ from prices available at physical retail locations, wholesale locations, events, or third-party retailers.


You agree to provide accurate and complete payment, billing, shipping, and account information. You authorize us and our payment processors to charge the payment method provided for all amounts associated with your order.


You represent that you are authorized to use the payment method provided and that charges submitted using that payment method will be honored.


SECTION 6 — PREORDERS


Certain Saints on a Shelf™ products may be offered for preorder before production is complete or inventory is available for immediate shipment.


Unless otherwise stated on the product page, payment for a preorder is collected in full when the preorder is placed.


Estimated production, arrival, and delivery dates are good-faith estimates and are not guaranteed. Production or delivery may be affected by manufacturing schedules, minimum production requirements, presale goals, quality-control reviews, freight transportation, customs processing, carrier delays, weather, supply interruptions, or other circumstances outside our control.


We will make reasonable efforts to provide material production or shipping updates using the email address associated with the order. Customers are responsible for keeping their contact information current.


If an order contains both available and preorder products, the products may be shipped together when all products become available or separately, depending on the shipping method, product availability, and information provided at checkout.


Preorder cancellation and refund requests are governed by the Refund Policy in effect when the order is placed.


If we determine that a preordered product cannot be produced or fulfilled, we may cancel the affected item and issue a refund using the original payment method.


SECTION 7 — SHIPPING AND DELIVERY


Shipping and delivery times are estimates and are not guaranteed.


We are not responsible for delays caused by carriers, customs authorities, weather, natural disasters, incorrect customer information, or circumstances outside our reasonable control.


Customers are responsible for providing an accurate and complete delivery address. Additional shipping charges resulting from an incorrect or incomplete address may be charged to the customer where permitted by law.

Nothing in this section limits rights or remedies that cannot legally be limited under applicable consumer-protection laws.


SECTION 8 — SAINTLINK™ AND DIGITAL DEVOTIONAL CONTENT


Certain Saints on a Shelf™ collectibles may include access to Saintlink™, a digital devotional experience that may provide saint stories, prayers, Scripture, images, videos, devotional reflections, patronage information, feast-day information, and related content.


Saintlink™ access may be provided through a unique QR code, access link, account, or other access method included with an eligible collectible.


Saintlink™ access is intended for the purchaser or intended gift recipient. Unique QR codes and private access links should not be photographed, published, posted publicly, reproduced, sold separately, or distributed to people who do not own the associated collectible.


When available, customers may add an eligible saint to a My Saints account so the devotional content can be accessed without rescanning the original QR code.


Purchasing a collectible or accessing Saintlink™ grants the authorized user a limited, revocable, nonexclusive, nontransferable license to view and use the associated content for personal, household, educational, and noncommercial devotional purposes.


The purchase of a collectible does not transfer ownership of any copyright, trademark, website design, story, prayer compilation, image, video, graphic, or other Saintlink™ content.


Saintlink™ content may be updated, expanded, corrected, reorganized, or replaced over time. We may temporarily interrupt access for maintenance, security, upgrades, technical problems, or circumstances outside our control.


If a QR code or access card is lost or damaged before the saint is saved to an account, we may request reasonable proof of purchase or ownership before assisting with restoration. Replacement or restored access is not guaranteed when ownership cannot reasonably be verified.


We may suspend or terminate Saintlink™ access when an access code is publicly distributed, used fraudulently, compromised, or used in violation of these Terms.


SECTION 9 — LIMITED AND NUMBERED EDITIONS


Products are considered limited, numbered, Founders Edition, or special edition products only when specifically identified as such in the product description or accompanying materials.


Where a product includes an edition number, numbered sticker, or Certificate of Authenticity, the edition information included with the product is intended to correspond to that particular collectible.


Unless expressly confirmed in writing, customers may not request or reserve a particular edition number.


If a numbered product must be replaced because of verified damage or defect, an identical edition number may not be available. Any replacement is subject to available inventory and our Refund Policy.


Packaging variations, minor production differences, and hand-painted variations do not change the authenticity of an otherwise genuine limited-edition product.


SECTION 10 — DEVOTIONAL AND EDUCATIONAL INFORMATION


Stories, prayers, Scripture references, reflections, videos, images, and other materials provided through Saints on a Shelf™ or Saintlink™ are offered for general devotional, educational, and informational purposes.


This content is not intended to replace guidance from clergy, sacramental preparation, official Church teaching, professional counseling, medical advice, legal advice, or other qualified professional services.


While we make reasonable efforts to provide respectful and accurate faith-based information, we do not guarantee that every item of content will meet every user’s personal, theological, educational, or devotional expectations.


SECTION 11 — INTELLECTUAL PROPERTY


The Services—including the Saints on a Shelf™ and Saintlink™ names and logos, product concepts and designs, text, saint stories, devotional arrangements, graphics, photographs, videos, audio, packaging, website appearance, and selection and arrangement of content—are owned by or licensed to Saints on a Shelf LLC and are protected by applicable intellectual-property laws.


These Terms permit personal and noncommercial use of the Services only.


Except where expressly permitted, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, scrape, store, sell, license, or transmit our materials without prior written permission.


Nothing in these Terms grants ownership or a license to use any Saints on a Shelf™ or Saintlink™ trademark, trade dress, copyrighted work, product design, or other intellectual property except for the limited personal-use rights expressly provided.


Shopify’s name, logos, product names, and service names are trademarks of Shopify. Other names, logos, and materials appearing through the Services may be owned by their respective owners.


All rights not expressly granted are reserved.


SECTION 12 — OPTIONAL TOOLS


We may provide access to tools or services offered by third parties that we do not control or monitor.


Third-party tools are provided “as is” and “as available,” without warranties, representations, or endorsements from us. Your use of optional third-party tools is at your own discretion and risk.


You are responsible for reviewing the terms and privacy practices of the applicable third-party provider.


New tools, features, and resources offered through the Services will also be subject to these Terms unless separate terms are provided.


SECTION 13 — THIRD-PARTY LINKS AND CONTENT


The Services may include links, embedded videos, references, or functionality provided by third parties.


We are not responsible for examining or guaranteeing the accuracy, availability, safety, or content of third-party websites or services.


If you leave our Services to access a third-party website, you do so at your own discretion and should review that third party’s policies and practices.


Questions or claims concerning a third-party product, service, website, or content should be directed to the applicable third party.


SECTION 14 — RELATIONSHIP WITH SHOPIFY


Saints on a Shelf™ is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Saints on a Shelf LLC.


By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Saints on a Shelf LLC, including any injury, damage, or loss resulting from purchased products or services.


You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with Saints on a Shelf LLC.


SECTION 15 — PRIVACY


Personal information collected through the Services is governed by our Privacy Policy:

Because portions of the Services are hosted by Shopify, Shopify may collect and process information relating to your access to and use of the Services.


Information submitted through the Services may be transmitted to Shopify and other service providers, including providers operating in countries outside your place of residence, when necessary to provide the Services.


By using the Services, you acknowledge that you have reviewed the applicable privacy policies.


SECTION 16 — FEEDBACK, REVIEWS, AND SUBMISSIONS


If you submit reviews, photographs, testimonials, suggestions, ideas, comments, or other materials (“Feedback”), you grant Saints on a Shelf LLC a worldwide, nonexclusive, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display that Feedback for purposes connected with operating, improving, and promoting the Services.


You represent that you own or have permission to submit the Feedback and that its use will not infringe another person’s copyright, trademark, privacy, publicity, or other rights.


You must disclose any compensation or incentive received in connection with a review or testimonial.


You may not submit unlawful, misleading, defamatory, threatening, obscene, abusive, infringing, or malicious content.


We may monitor, edit, decline to publish, or remove Feedback at our discretion, subject to applicable law.


SECTION 17 — ERRORS, INACCURACIES, AND OMISSIONS


The Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, prices, promotions, shipping charges, transit times, availability, or other information.


We reserve the right to correct errors, update information, and cancel or adjust affected orders when information is materially inaccurate, including after an order has been submitted, subject to applicable law.


If an affected order is canceled after payment, we will refund the canceled amount using the original payment method.


SECTION 18 — PROHIBITED USES


You may use the Services only for lawful purposes.


You may not use the Services to:


1. Violate applicable laws or regulations;

2. Infringe our intellectual property or the rights of another person;

3. Harass, threaten, abuse, impersonate, defame, or harm another person;

4. Submit false, fraudulent, or misleading information;

5. Upload malicious software or interfere with the Services;

6. Collect or track another person’s personal information without authorization;

7. Send spam, phishing messages, or unauthorized solicitations;

8. Reproduce, resell, scrape, or commercially exploit the Services or Saintlink™ content;

9. Bypass access controls or share private Saintlink™ access credentials publicly;

10. Use automated systems in a manner that disrupts, burdens, circumvents, or compromises the Services; or

11. Engage in conduct that restricts another person’s use of the Services or exposes Saints on a Shelf LLC, Shopify, or users to liability.


We may suspend, disable, or terminate access when we reasonably determine that these Terms have been violated.


SECTION 19 — AUTOMATED AGENTS


This section applies if you use or enable an autonomous or semi-autonomous software agent (“Agent”) to access or interact with the Services.


An Agent must accurately identify itself, must not impersonate a human, must not circumvent CAPTCHAs or other access controls, and must truthfully disclose that it is an automated system when asked.


We may restrict or prohibit Agent access through technical or administrative measures.


No Agent may access or interact with the Services after we request that it stop or when doing so would violate these Terms or applicable law.


SECTION 20 — TERMINATION


We may suspend or terminate your access to all or part of the Services if you violate these Terms, misuse Saintlink™ access, engage in fraud, compromise the security of the Services, or create a risk of harm or liability.


You remain responsible for amounts lawfully due through the termination date.


Provisions concerning intellectual property, Feedback, disclaimers, limitations of liability, indemnification, governing law, and other provisions that by their nature should survive will remain effective following termination.


SECTION 21 — DISCLAIMER OF WARRANTIES


To the fullest extent permitted by law, the Services and products offered through the Services are provided “as is” and “as available,” except for warranties expressly stated by Saints on a Shelf LLC or warranties that cannot legally be excluded.


We do not guarantee that digital Services will always be uninterrupted, timely, secure, or error-free.


We disclaim implied warranties of merchantability, fitness for a particular purpose, title, durability, and noninfringement to the extent those warranties may lawfully be disclaimed.


Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.


Nothing in these Terms excludes consumer rights or warranties that cannot legally be waived.


SECTION 22 — LIMITATION OF LIABILITY


To the fullest extent permitted by law, Saints on a Shelf LLC and its officers, employees, agents, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages arising from or related to the Services or products purchased through the Services.


This limitation includes, where legally permitted, lost profits, lost revenue, loss of data, replacement costs, and similar damages.


Nothing in these Terms limits liability that cannot legally be limited, including liability arising from fraud, intentional misconduct, or other liability that applicable law prohibits us from excluding.


SECTION 23 — INDEMNIFICATION


To the extent permitted by law, you agree to indemnify and hold harmless Saints on a Shelf LLC, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, damages, losses, and reasonable expenses arising from:


1. Your material breach of these Terms;

2. Your violation of applicable law;

3. Your violation of another person’s rights; or

4. Your unauthorized or unlawful use of the Services.


We will provide reasonable notice of an indemnifiable claim, and you agree to cooperate reasonably in its defense.


SECTION 24 — SEVERABILITY


If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the greatest extent permitted by law and severed only to the extent necessary.


The remaining provisions will continue in effect.


SECTION 25 — WAIVER AND ENTIRE AGREEMENT


Our failure to exercise or enforce a right or provision does not waive that right or provision.


These Terms and the policies referenced herein constitute the entire agreement between you and Saints on a Shelf LLC concerning your use of the Services, except where separate written terms apply to an authorized wholesale account, promotion, or other specific program.


SECTION 26 — ASSIGNMENT


You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent.


We may assign or transfer these Terms and our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, change of control, or other lawful business transaction.


SECTION 27 — GOVERNING LAW


These Terms and any separate agreements through which we provide Services are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles.


Unless applicable law requires otherwise, legal proceedings concerning these Terms shall be brought in an appropriate state court located in San Miguel County, New Mexico, or in an appropriate federal court serving the State of New Mexico.


Nothing in this section prevents either party from pursuing a remedy in another venue when required or permitted by applicable law.

Section headings are provided for convenience and do not limit or affect the meaning of these Terms.


SECTION 29 — CHANGES TO THESE TERMS


The current version of these Terms will be available on this page.


We may update or replace portions of these Terms by publishing a revised version. When required by applicable law, we will provide notice of material changes.


The effective date displayed at the beginning of these Terms identifies the most recent revision.


Your continued use of the Services after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.
